NATS Santair Christmas Competition 2022 (“Competition”)

2 Competition

NATS will each day for a period of 29 days commencing at 10:00 GMT on Thursday 1 December 2022 promote the NATS online game “Santair” via LinkedIn, Facebook, Twitter and Instagram.

Participants who play the game will be eligible to register their scores on the NATS Santair Leaderboard (“Leaderboard”).

Santair and Leaderboard shall be available between 1 December and 29 December 2022 (“Competition Opening Period”).   All participants who have registered their scores on the Leaderboard are eligible to win the competition prizes.

The Competition closes at 2359 GMT 29 December 2022 (“Closing Date”).

3 Participation

In order to enter the Competition you (“Participant”) must submit your Score to the Leaderboard within the Competition Opening Period.

The five highest scoring unique Participants at 2359 GMT 29 December will be deemed the “Winning Participants”.  Should one Participant hold more than one of the top scores, they will only be deemed as 1 Winning Participant and eligible for 1 prize.  The next highest scoring individuals will also be “Winning Participants”, until all five prizes have been awarded.

The Winning Participants will each win one NATS goody bag, including a selection of NATS branded merchandise (“Competition Prize”).

NATS will notify the Winning Participants via the email address they submitted with their Santair score submission.

This competition is open to UK residents only, excluding NATS employees, contractors, officers and directors who are not eligible to enter.

Use of a false or incomplete name or address will result in disqualification. Submissions that are incomplete, illegible, indecipherable, or inaudible will not be valid and deemed void. Submissions must be made directly by the Participant entering the Competition.

Participants may play as often as they choose, however, only one Competition Prize per Participant shall be awarded.

4 Selection of the Winners

All Participants who submit their Santair score by the method described in Paragraph 3 within the Competition Opening Period, will be eligible for a chance to win a “Competition Prize”.  They will be notified during the week following the Closing Date with details of how to claim their Competition Prize.

NATS reserves the right to make the final decision as to which Participants shall be awarded a Competition Prize. By entering into the Competition, the Participant acknowledges that they will provide a postal address (to which a Competition Prize can be sent (see below)) and an email address through which the Participant will be notified should they have won a Competition Prize and that their response may be used in publicity if they are selected as a Winning Participant.

5 Prizes

There shall be no more than 5 Winning Participants. No further prizes of any nature shall be awarded after the Closing Date.

Each Competition Prize is as stated, is non-exchangeable, non-transferable and no replacement or cash alternative shall be offered. The Winning Participant will be notified by email, using the email address set out in their entry, promptly after the Closing Date (“Date of Notification”).  Reasonable efforts will be made to contact each Winning Participant. If a Winning Participant cannot be contacted within 7 days of the Date of Notification, is unable or unwilling to comply with these terms and conditions, or if the required details are not provided within 7 days after the Date of Notification, NATS reserves the right to withdraw the Competition Prize from that Winning Participant, and award it to the next Winning Participant.

6 Acceptance of Terms and Conditions

Please note that by entering into this competition, the Participant is deemed to have accepted these terms and conditions.

Entrants under the age of 18 must get consent from their parent(s) or legal guardian(s) before entering and provide contact details of a parent or legal guardian when entering.  The parent(s) or legal guardian(s) of entrants under 18 agree to these terms and conditions on behalf of such entrants.

In the event of a dispute as to the identity of any Participant the authorised account holder of the email address used to enter the Competition will be deemed to be the Participant.  At NATS’ sole discretion, the Winner may be required to show evidence of being the authorised account holder.  The “authorised account holder” is the natural person assigned an email address by an internet access provider, online service provider, wireless carrier or other organisation responsible for assigning such email address.

7 Data Protection

NATS is committed to protecting and respecting your privacy and will only use your personal information in accordance with these terms and conditions and NATS’ privacy policy which is available on our website at:  http://www.nats.co.uk/home/cookies-privacy-policy/.

By entering the Competition, you agree that any personal information provided by you with your entry may be held and used by NATS or its agents and suppliers to administer the Competition including but not limited to publishing the details of the Winning Participant (name/username, screen grabbed answer name and photograph) on its website, intranet and social media channels (including but not limited to Facebook, Twitter, Instagram).

The username, screen grabbed answer name and photograph of the Winner might be published on nats.aero and NATS social media channels. By entering into these terms and conditions you give NATS consent to publish these details.

The Winner will co-operate with any other reasonable requests by NATS relating to any post-winning publicity.

By entering the Competition, you are agreeing to receive future communication from NATS. If you do not wish to receive future communication, please specify this in your email to us. In any event, you may unsubscribe at any time.

8 Liability

Subject to the below and to the Competition Prize rightfully due to each Winner, NATS shall have no liability whatsoever under these terms and conditions.

Nothing in these terms and conditions will limit NATS’ liability for death or personal injury caused by its negligence or for fraud.

NATS will not accept responsibility for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

NATS cannot guarantee that the services relating to the Competition will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of NATS. NATS will not be liable in the event that all or any part of the service relating to the Competition is discontinued, modified or changed in any way.

9 General

Entries made online using methods generated by a script, macro or the use of automated devices will be void.

NATS reserves the right to amend or alter these terms and conditions at any time and any updated version will be effective as soon as it is published on NATS website (www.nats.aero).

The Competition may be modified or withdrawn at any time.

These terms and conditions shall be governed by and construed in accordance with the laws of England and any disputes arising therefrom shall be subject to the non-exclusive jurisdiction of the English courts.

There is no minimum age limit unless specified otherwise in the competition information. However, entrants under the age of 18 must insert contact details of a parent or guardian when entering.

Any entrant who enters or attempts to enter the Competition in a manner, which in NATS’ determination is contrary to these terms and conditions or the spirit of the Competition, or by its nature is unfair to other entrants may be removed from the Competition at NATS’ sole discretion.

The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
